Factory Sound Sales Pty Limited ACN 067 110 098, its subsidiaries and affiliates in Australia (collectively referred to as [Factory Sound]) are committed to managing personal information in accordance with the Australian Privacy Principles (APP) under the Privacy Act 1988 (Cth) and in accordance with other applicable privacy laws. We recognise that to run our businesses successfully we must maintain high standards when it comes to how we collect, hold, use and disclose Personal information. We recognise everyone’s right to privacy and have established several protocols to help us keep the information we hold accurate, up-to-date and complete.
This document sets out our policies for managing your personal information and is referred to as our Privacy Policy. In this Privacy Policy, “we” and “us” refer to Factory Sound and “you” refers to any individual about whom we collect personal information.

- How does Factory Sound collect information about you?
Factory Sound may collect Personal Information from third parties. The sources of that Personal Information include those listed below, depending upon the purpose for which it is being collected.
- Real estate agents and real estate platforms/websites;
- Utility Providers;
- Lawyers, Insurers, Loss assessors, Loss adjustors and investigators;
- Law courts;
- Credit providers, other financial institutions and access seekers;
- Australian Securities and Investments Commission;
- Australian Financial Security Authority;
- Australian Tax Office;
- Telstra and other telecommunication providers;
- Australia Post;
- Australian Electoral Commission;
- Australian Communications and Media Authority;
- Market research organisations;
- Direct marketing companies;
- Service Providers to us;
- Government agencies (such as the Office of the Australian Information Commissioner (OAIC) and the Federal Department of Human Services (DHS));
- External Dispute Resolution schemes such as Australian Financial Complaints Authority (AFCA);
- Our customers;
- Our related companies;
- Your nominated representatives e.g. spouse, accountant, attorney under power of attorney, broker or other professional adviser;
- Referees whose details you have provided to us; or
- Universities, health care professionals, law enforcement agencies, and other third parties for Employment Verification purposes, described further below.
- What information does Factory Sound collect about you?
(a) Clients and prospective clients
When you enquire about our services or when you become a client of Factory Sound, a record is made which includes your personal information.
The type of personal information that we collect will vary depending on the circumstances of collection and the kind of service that you request from us, but will typically include:
- your name, e-mail, postal address and other contact details; information about your employer or an organisation who you represent;
- your professional details; and any additional personal information you provide to us, or authorise us to collect, as part of your interaction with Factory Sound.
(b) Prospective employees or applicants
The Privacy Act provides an exemption for employee records. That is, information about an individual if that information directly relates to the act or practice of a current or former employee relationship between an employer and the individual. That exemption may apply in relation to your personal information held by us about you as an employee.
We collect personal information when recruiting personnel, such as your name, contact details, qualifications and work history. Generally, we will collect this information directly from you. Any personal information provided to Factory Sound in connection with job applications may be used to consider you for current and future employment and may be disclosed to our third-party advisors to assist us in the section and recruitment process. Before offering you a position, we may collect additional details such as your tax file number, superannuation information and other information necessary to conduct background checks to determine your suitability for certain positions (for example, positions that involve working with children).
(c) Other individuals
Factory Sound may collect personal information about other individuals who are not Factory Sound clients. This includes customers and members of the public who participate in events we are involved with, individual service providers and contractors to Factory Sound, and other individuals who interact with Factory Sound on a commercial basis. The kinds of personal information we collect will depend on the capacity in which you are dealing with Factory Sound. Generally, it would include
- your name, e-mail, postal address and other contact details; information about your employer or an organisation who you represent;
- your financial and credit card information;
- your professional details; and
- any additional personal information you provide to us, or authorise us to collect, as part of your interaction with Factory Sound.
If you are participating in an event or other service we are managing or delivering, we
may take images or audio-visual recordings that identify you or your brand.
In limited circumstances, Factory Sound may collect information that is considered sensitive information. For example, if you are injured at an event promoted or delivered by Factory Sound, we may collect health information about you in an emergency or otherwise with your consent.
We may collect personal information about children (for example, when children participate in events or services we are involved with). Where children do not have sufficient maturity and understanding to make decisions about their personal information, we will require their parents or guardians to make decisions on their behalf.
You can always decline to give Factory Sound any personal information we request, but that may mean we cannot provide you with some or all of the services you have requested. If you have any concerns about the personal information we have requested, please let us know.

How we handle the personal information of visitors to our websites is discussed below.
- The kinds of, and purposes for which Factory Sound collects, holds, uses and discloses Personal Information
Factory Sound collects personal information reasonably necessary to carry out our business, assess and manage our client’s needs, and provide services. We may also collect information to fulfil administrative functions associated with these services, for example, billing, entering into contracts with you or third parties and managing client relationships.
The purposes for which Factory Sound usually collects and uses personal information depends on the nature of your interaction with us but may include:
(a) responding to requests for information and other general inquiries;
(b) managing, planning, advertising and administering programs, events, competitions and performances;
(c) researching, developing, planning and expanding our facilities and services;
(d) informing you of our activities, events, facilities and services;
(e) recruitment processes (including volunteers, internships and work experience); and
(f) responding to enquiries and complaints.
Factory Sound generally collects personal information directly from you. We may collect and update your personal information over the phone, by email, over the Internet, social media, or in person. We may also collect personal information about you from other sources, for example, our companies, clients and other third parties.
Factory Sound also collects and uses personal information for market research purposes and to innovate our delivery of products and services.
In accordance with the Act, Factory Sound may disclose your Personal Information to third parties who are customers of one of our businesses. Factory Sound may also disclose your Personal Information to:
- service providers, including data storage providers, call centre operations, technology and operations support providers, who assist us with providing products and services and conducting our business activities (and those service providers may in turn provide us with Personal Information collected from you in the course of providing the relevant product or service);
- professional service providers and advisors who perform functions on our behalf, such as lawyers;
- external dispute resolution schemes;
- access seekers as contemplated and permitted by the Privacy Act;
- our related companies;
- other third parties where it is necessary to enable us to provide a product or service;
- referees or employers whose details you have provided to us (for example, information about persons who have applied for a job at Factory Sound is disclosed with their consent to their employer or referee as part of the employment application process); and
- where otherwise permitted by law.
There may be other circumstances where we are required or authorised by law to disclose your Personal Information to someone, for example to an Ombudsman, tribunal, court, law enforcement agency or government department.
- How does Factory Sound interact with you via the internet?
You may visit our website www.factorysound.com without identifying yourself. If you identify yourself (for example, by providing your contact details in an enquiry), any personal information you provide to Factory Sound will be managed under this Privacy Policy.
Factory Sound’s websites use cookies. A “cookie” is a small file stored on your computer’s browser, which assists in managing customised settings of the website and delivering content. We collect certain information such as your device type, browser type, IP address, and pages you have accessed on our websites and third-party websites. You are not identifiable from such information.
You can use the settings in your browser to control how your browser deals with cookies. However, in doing so, you may be unable to access certain pages or content on our website.
Factory Sound’s websites may contain links to third-party websites. Factory Sound is not responsible for the content or privacy practices of websites that are linked to our website.
- Can you deal with Factory Sound anonymously?
Factory Sound will provide individuals with the opportunity of remaining anonymous or using a pseudonym in their dealings with us where it is lawful and practicable (for example, when making a general enquiry). Generally, it is not practicable for Factory Sound to deal with individuals anonymously or pseudonymously on an ongoing basis. If we do not collect personal information about you, you may be unable to utilise our services or participate in any of our events, programs or activities we manage or deliver.
- How does Factory Sound hold information?
Factory Sound stores information in paper-based files or other electronic record-keeping methods in secure databases (including trusted third-party storage providers based in Australia and overseas, including the USA). Personal information may be collected in paper-based documents and converted to electronic form for use or storage (with the original paper-based documents either archived or securely destroyed). We take reasonable steps to protect your personal information from misuse, interference and loss and from unauthorised access, modification or disclosure.
Factory Sound maintains physical security over paper and electronic data stores, such as through locks and security systems at our premises. We also maintain computer and network security, for example, we use firewalls (security measures for the internet) and other security systems such as user identifiers and passwords to control access to our computer systems.
Our websites do not necessarily use encryption or other technologies to ensure the secure transmission of information via the Internet. Users of our websites are encouraged to exercise care in sending personal information via the internet.
We take steps to destroy or de-identify information that we no longer require.
- Does Factory Sound use or disclose your personal information for direct marketing?
Factory Sound may use or disclose your personal information for the purpose of informing you about our services, upcoming promotions and events, or other opportunities that may interest you. If you do not want to receive direct marketing communications, you can opt out at any time by contacting us using the contact details below.
If you opt-out of receiving marketing material from us, Factory Sound may still contact you in relation to its ongoing relationship with you.
- How does Factory Sound use and disclose personal information?
(a) For clients
The purposes for which we may use and disclose your personal information will depend on the services we are providing you. For example, if you have engaged us to deliver a service, we may disclose information about you to service providers where this is relevant to our services.
(b) For customers, clients and participants
If you are a customer, client or participant in an event, we may disclose your personal information where this is reasonably necessary for, and relevant to, the delivery of our services. We may use images or audio-visual recordings that identify you for promotional purposes where you would reasonably expect this to occur.
(c) For marketing purposes
We may use or disclose your personal information for marketing purposes, including marketing our services. This may also include past or current projects. This may include, without limitation, EDM.
(d) Disclosure to contractors and other service providers
Factory Sound may disclose information to third parties we engage to provide our services, including contractors and service providers used for data processing, data analysis, customer satisfaction surveys, information technology services and support, website maintenance/development, printing, archiving, mail-outs, and market research.
Personal information may also be shared between related and affiliated companies of Factory Sound, located in Australia and overseas.
Third parties to whom we have disclosed your personal information may contact you directly to let you know they have collected your personal information and to give you information about their privacy policies.
(e) Use and disclosure for administration and management
Factory Sound will also use and disclose personal information for a range of administrative, management and operational purposes. This includes:
- administering billing and payments and debt recovery; planning, managing, monitoring and evaluating our services;
- quality improvement activities;
- statistical analysis and reporting;
- training staff, contractors and other workers;
- risk management and management of legal liabilities and claims (for example, liaising with insurers and legal representatives);
- responding to enquiries and complaints regarding our services;
- obtaining advice from consultants and other professional advisers; and
- responding to subpoenas and other legal orders and obligations.
(f) Other uses and disclosures
We may use and disclose your personal information for other purposes explained at the time of collection or otherwise as set out in this Privacy Policy.
- Does Factory Sound disclose your personal information overseas?
Factory Sound is a global organisation that works with clients, service providers, sponsors and commercial interests across the globe. It is likely that your personal information will be disclosed to overseas recipients.
Unless we have your consent, or an exception under the APP applies, we will only disclose your personal information to overseas recipients where we have taken reasonable steps to ensure that the overseas recipient does not breach the APP about your personal information.
Factory Sound uses cloud service providers for data storage and processing which means that your Personal Information, other than credit information, may be held in overseas locations.
Factory Sound may disclose your Personal Information to its overseas customers when it provides services to those customers.
As part of a global group providing services to customers and in dealing with our customer relationships, Factory Sound may also disclose or provide access to Personal Information (other than credit information) of an organisation’s employees, contractors or other service providers to overseas entities. This occurs, for example, where we have engaged overseas entities to provide services (including technology, operations, billing, administrative and customer support) to us, and they need to access that Personal Information to provide those services.
By dealing with us, an organisation or other business entity acknowledges that these service arrangements may result in Personal Information provided by it or collected about individuals being disclosed to or used by an overseas recipient and that:
- the overseas recipient may not be required to protect that Personal Information in a way that provides comparable safeguards to those required under the Privacy Act;
- the overseas recipient may be subject to a foreign law that could compel the disclosure of Personal Information to a third party, such as an overseas authority (for example, under legislation to intercept cyber traffic or obstruct terrorism), and the individual may not be able to seek any redress in that overseas jurisdiction; and
- that it is satisfied that the disclosure and use of Personal Information is consistent with its own privacy policy and privacy obligations.
- How can you access or seek correction of your personal information?
You are entitled to access your personal information held by Factory Sound on request. To request access to your personal information please contact our privacy officer using the contact details set out below.
You will not be charged for making a request to access your personal information, but you may be charged for the reasonable time and expense incurred in compiling information in response to your request.
We will take reasonable steps to ensure that the personal information we collect, use or disclose is accurate, complete and up-to-date. You can help us to do this by letting us know if you notice errors or discrepancies in the information, we hold about you and letting us know if your personal details change.
However, if you consider any personal information, we hold about you to be inaccurate, out-of-date, incomplete, irrelevant or misleading you are entitled to request correction of the information. After receiving a request from you, we will take reasonable steps to correct your information.
We may decline your request to access or correct your personal information in certain circumstances following the APP. If we do refuse your request, we will provide you with a reason for our decision and, in the case of a request for correction, we will include a statement with your personal information about the requested correction.
- What should you do if you have a complaint about the handling of your personal information?
You may contact Factory Sound at any time if you have any questions or concerns about this Privacy Policy or about how your personal information has been handled.
You may make a complaint about privacy to the privacy officer at the contact details set out below.
- The privacy officer will first consider your complaint to determine whether there are simple or immediate steps that can be taken to resolve the complaint. We will generally respond to your complaint within a week.
- If your complaint requires more detailed consideration or investigation, we will acknowledge receipt of your complaint within a week and endeavour to complete our investigation into your complaint promptly. We may ask you to provide further information about your complaint and the outcome you are seeking. We will then typically gather relevant facts, locate and review relevant documents and speak with individuals involved.
- In most cases, we will investigate and respond to a complaint within 30 days of receipt of the complaint. If the matter is more complex or our investigation may take longer, we will let you know.
- If you are not satisfied with our response to your complaint, or you consider that Factory Sound may have breached the APP or the Privacy Act, a complaint may be made to the Office of the Australian Information Commissioner. The Office of the Australian Information Commissioner can be contacted by telephone on 1300 363 992 or by using the contact details on the website www.oaic.gov.au.
- Do we collect any other data?
We may collect data regarding users’ online activities over time on our online network of internet sites, non-affiliated websites, mobile applications or online services including information that you voluntarily provide to us online or offline, for example in response to surveys or competitions.
We will not combine this data with Personal Information about you for sharing with any third party, nor will we provide it to an advertiser or any other third party without your express consent, or as expressly stated in this policy.
For third party online behavioural advertising, we may disclose any data about your activities which is not Personal Information and does not allow you to be reasonably identifiable to a third party – for example, data associated with a cookie, pixel tag, mobile advertising ID or other tracking code – and permit them to use this data for the purpose of associating that tracking code with your use of our websites, and of third party websites where we or our advertising partners have an arrangement in place to serve ads to you on those third party websites.
We may also collect and use, and permit third parties to collect and use, data from third parties about your online or offline activities, as linked by that third party to that tracking code, to facilitate display of advertisements, goods, services, recommendations or content to you that are selected using inferences as to your preferences or interests. For example, we may collect information related to demographic, behavioural and usage patterns, referred to as “preference data”. By targeting ads and content to unidentified individuals (such as you) only if you are within a particular interest or preference segment, targeted advertising and targeted content is intended to be more relevant or useful to you.

Factory Sound has never and will never sell, rent or distribute our InfoPool database information to any other company.
Long-term Factory Sound customers know that we are fiercely independent, and we protect not only your information but also your own livelihood.
Factory Sound collects personal data responsibly at the point of sale, and during the quoting process – whether these discussions have happened in-store, via telephone, or via email inquiry. This information is kept inside our point-of-sale software, not inside our sales staff’s personal address books. We do this to ensure that quotations are accurate and if any further discussions are required before a purchase is completed, our sales staff have all the necessary tools to make follow-up contact, including telephone and email references – regardless of who is helping you through the process.

- A note on spam
Factory Sound DOES NOT deliberately send unsolicited emails. If you are receiving emails from [email protected], it means you have submitted your email address to us on one (or more) of the following occasions:
- You gave it to us at Point of Sale; You subscribed via our website;
- You registered for one of our sales;
- You swiped an information card at one of our trade show appearances;
- Somebody else used your email address for any of the above bullet points;
- You have purchased an item from our website;
- You otherwise provided it in a matter provided for in this Privacy Policy;
